Madhav Menon Committee suggests changes in legal sys, Police
functioning

More than one year back, the UPA government had set up the Madhav
Menon Committee for recommending necessary changes in the legal
system. Now, the Menon committee has recommended some important
changes necessary for better police functioning and changes in the
existing legal system in the country.
According to the report, Menon committee is likely to submit the
report to Home Minister Shivraj Patil on Wednesday. NDTV has showed
some of the key recommendations suggested by the Menon report, which
are such as:
# The government should grant compensation for victims of serious and
dreadful crimes.
# There should be more Codes instead of existing codes such as Indian
Penal Code and Code of Criminal Procedure.
# It suggested to introduce other Codes such as Social Welfare Code,
Correction Offences Code to deal cases of marriage offences,
prohibition offences, vagrancy and campus indiscipline.
# There should be the Economic Offence Code to deal with the threat to
the country’s economic health.
# A Federal agency should be introduced to deal with terror threats
and organized crime in country.
# There should be some Alternative punishments instead of imposition
of fines and imprisonment.
# The committee has suggested introducing the Independent bodies to
correct unethical practices.
# Protection of the witnesses is must to deliver justice and there
should be a separate law to give proper protection to witnesses.
# The government should impose a security cess on large industrial
houses in the country.
# The Security forces should make a fund for Victim Compensation.
The committee would present the report to Home Ministry and the
government would discuss on the recommendations and the matter would
go to parliamentary standing committee for further look on the
suggestions.

“Who is Raj Thackeray? I know Bala Saheb, father-like figure to us and
Uddhav Thackeray only”, said Jaya Bachchan, who is the wife of Amitabh
Bachchan and Rajya Sabha MP from Samajwadi Party. She said it in a
press conference in Mumbai in the reaction of Raj Thackeray’s comment
against Big B that he didn’t do anything for Mumbai when Mumbai has
given him such name, fame, and money.
The major question is – Who is Raj Thackeray? Is he like Kalyan Singh
without Bhartiya Janta Party, Raj Babbar without Samajwadi Party, Uma
Bharti without BJP, Natwar Singh without Congress? I think yes, Raj
Thackeray is now Raj Thackeray without Shiv Sena. And he is
desperately trying to be in media all the time like his ‘Sena’ days.
He has become infamous for doing ’shortcuts’ to get cheap popularity
and this time he has opted the God Sun (Chath Puja), Amitabh Bachchan
and his favorite ‘Biharis’ to polish his politics.
Let me tell you who Raj Thackeray is in detail. Raj Thackeray is a
young Indian politician of Maharashtra and best known as nephew of
Bala saheb Thackeray till date. He started his political career with
Shiv Sena in Maharashtra and it was possible because he has the title
‘Thackeray’. He started dreaming to become the chief minister of
Maharashatra in the initial phase of his political career. He even had
revealed his wish in 2004 but didn’t contest the assembly elections.
He had the status of number three in party but had a dream to become
number one by overtaking Uddhav Thackeray, son of Bala Saheb. Later,
he was sidelined and forced to give way to Uddhav to become Shiv
Sena’s executive President in 2005. Raj, highly ambitious youth,
decided to leave Shiv Sena and float a new party, Maharashtra
Navnirman Sena (MNS) to fulfill his dream. He believes he has wide
support in Maharashtra, particularly in Mumbai. However, he failed
completely in establishing himself in the last assembly election and
the civic body polls in the state. On the other hand, Uddhav managed
everything correctly in Shiv Sena, the party without Narayan Rane,
Chagan Bhujbal and now Raj Thackeray.
Raj has another quality in him; he admires Nazi dictator Hitler for
his organizational skills and strong will power. On his 37th birthday
in 2005, he said:
“‘Leave aside his negative aspects like the barbaric annihilation of
millions of Jews. There are several other things about Hitler, which
any leader would envy. Hitler had everything. The one thing he did not
have was the ambition to conquer the world. You can draw whatever
conclusions you want from my remarks.’
”People are talking about Raj as a desperate youth leader who is ready
to do everything to get a status of full fledged political leader in
the state. He wants to remain in media discussion so he opts to
criticize Chath Puja (famous festival of Bihar and UP) and Amitabh
Bachchan. He knows it better that by targeting ‘Big’ things; he would
automatically arrive in media limelight.
He sends goon to carry attack in media offices, to beat people of
Bihar and Uttar Pradesh on streets, to disrupt press conference of
other political parties, to hurl bottles in superstar’s houses, to
beat the jobless examinees, he says Juhu molestation case happened on
the New Year Day because people of Bihar and UP are living in Mumbai,
He says no Maharashtrians can do such acts, he threatens Biharis to
slap on their cheek every time, he admires Hitler and believes in
behaving like Nazi dictator, he can’t win even civic polls but aiming
to become the chief minister of Maharashtra or get the status of Bala
Saheb in the state, he wants to become Hindu leader but abuses Chath
Puja, the festival of Sun; he wants to reconstruct (Navnirman)
Maharashtra but believes highly in regionalism at threatening extent.
He aims to become a mass leader and becoming the leader of ‘goons’.
Migrants laborers are being target of separatists and militants in
Border States in northeastern states, and in Maharashtra now,
Thackeray is targeting them. Does Maharashtra really need this
‘Thackeray’ who believes in Goonda ‘Raj’?176750

harmony among people living in Mumbai. He deserves tight slaps on both
of his cheeks for his anti-nation activities. It was strange to see
him attending Mumbai’s top cop’s daughter wedding even a non-bailable
warrant was issued against him by Mumbai Police. Isn’t this a joke of

Friend, I have been living in Chakan near Pune from quite sometime
working in Volkswagen. (We call it Folkswagen though)
I was very much interested in the issue regarding all this, and why
that BMW went to Tamil Nadu despite the good infrastructure and
excellent support extended by state Govt. as well as from people here.
Most of my colleagues are Marathi and I got a reply to the above chain
mail in my inbox from him. This one single email is enough to
understand the issue I suppose.
I am not an Indian national by the way, I am from Britain. So, please
excuse me from your racist rants (if any) :-)

don’t bother, we should beat him up hard and ensure no one comes
first. This way, we ensure no one is educated. Basically, why should
we educate ourselves? Ideas of education sprung from the mind of
Mahatma Phule, again a Marathi Manoos. Let them build the Oxford of
the East. Why should we worry about the constitution of India? It was
written by a Marathi Manoos by the name of Ambedkar. After all,
‘Jugaad’ is our birthright. //

Chhath Puja is supposed to be performed in river Ganga. It should be

Visits to Mumbai, Pune, Nagpur, Nashik, Aurangabad, Ajanta and Ellora

there! My colleagues are busy getting a hands on knowledge of the

When people talk about Marathi vs non marathi issue that is seamering
these days, they seem to miss the main point. It is OK for people to
migrate within a country but it becomes an issue when this migration
is happening on large scale. When such a large number of people
migrate from north to Maharashtra it creates problems for the local
people and their culture. And this issue must be addressed. Violance
that SS or MNS are doing in Mumbai is absolutely wrong but that does
not mean their point is not valid. They do have a very valid point.
The same thing could happen in any other state.
One other point worth noting is that in Maharashtra land reforms were
successful to large extent but in UP/Bihar they were not. That has
created major social inequality in those states. Maharashtra is not
only economically well developed but it is also socially advanced
state. This is mainly due to social reformers like Agharkar, Phule,
Karve, Ambedkar etc. Credit for all this certainly goes to
Maharashtrians.

Asma Jehangir Fears India Under Threat Of Another Communal Riot

On her 18 day visit to India as UN Special Rapporteur on Freedom of
Religion and Belief, Asma Jehangir, renowned lawyer and human rights
activist of Pakistan, found that India, although a secular country
with sound religious legal framework, lags behind in meting-out
justice to its religious minorities.
Jehangir, who visited Amritsar, Delhi, Jammu, Srinagar, Ahmedabad,
Mumbai, Thiruvananthapuram, Bhubaneswar and Lucknow, for her study,
hailed India for its democratic values and human rights activism.
She found that although the minorities agreed that there is a sound
legal framework to protect religious freedom, yet they are
dissatisfied with its implementations. There are undue delays in the
investigations where communal riots are concerned. It is spreading
disillusionment and dissent among the religious minorities.
In the past two decades there have been major incidents of religious
violence; like the demolition of Babri Masjid, violence against
Muslims in Gujarat in 2002, atrocities against Christians in Orissa
last year, that have escalated out of proportion because of unheeded
impunity given to the perpetrators and political parties using
religion as a political tool to gain voter bank.
Jehangir warns if the situation is not checked soon, there might be
another major communal violence looming in the near future. She hopes
that active participation from the government and non-state actors can
help to dispel dissatisfaction among the minorities and bring about a
more conducive environment for all.

Minorities are always under threat to be killed by Hindu nationalists
in communal riots at any point of time. the state government sometimes

Jehangir may be correct, well for that matter the political parties
have been playing the vote bank card. This problem is even with the
Hindu majority in our country, which have been divided into various
categories e.g. the OBCs, SCs and the STs.
So the main problem does not only concern the minorities, infact the
reality is that the reserved classes representing the Hindu Majority
have a representation right up to the parliament which is not the case
with the minorities.
We must have a certain percentage of minorities’ representation in the
parliament and mandatory provision for reserving seats for them just
like seats are reserved for reserved classes whilst contesting
elections.
As far as the investigations of communal riots are concerned, this
problem is also confronted by other criminal matters i.e. the quantum
of delay is even eminent there. The only remedy in the matters where
the communal riots are involved is that they must be taken up by fast
track courts. If these riots happen to occur at grass root levels then
the mobile courts could be a remedy.

Woho!!! Arsalan when did you visit Gujarat or Maharashtra...probably
something you saw over a PTV broadcast...and if you know about the
aforesaid states u must have heard off Jamia in New Delhi.
Once our Cab Driver unintentionally hit a Muslim vegetable grocer in
that area and atleast a 100 Muslims were ready to chop us all at one
go. It was not before the cab driver parted away with 3 grands and
rubbed his nose on the grocer’s feet, that we were allowed to go.
Just for your records: I am not a religious stickler and have never
believed that a Muslim or a Hindu breathe differently. It’s just the
colour given to these issues by political parties and nothing more. No
religion preaches to kill. Sensationalist Media propagation is what
made you think all that. We love Muslims just the way we love Hindu’s.
Don’t just write what you feel/think but mention what you personally
experience.

The Rise Of White Collar Crimes In India

A recent survey reveals the dark side of the corporate India, the
growing number of white collar crimes committed every year. KPMG
India, an audit and consulting firm associated with its Swiss
Cooperative, KPMG International, has published its recent Fraudster
Survey 2007. The findings were collected from a questionnaire survey
sent out on October 2007 to India’s largest organization in public and
private sectors. The respondents included senior management
officials.
Greed, opportunity and pressures to meet budgets and targets are the
most overriding motivations for white-collar crimes. Surprisingly,
most of the crimes were committed by senior level officials; 86% of
the fraudsters held management positions of which 60% were either at
senior management level or in the board of directors. Of these 68% of
the profilers were acting independently and they were not satisfied
with one time act, but 91% of the fraudsters had repeatedly cheated
their company.
The number of years with the company didn’t have a positive effect
either; about 26% of the employees had been 3-5 years in the company,
29% of them 6-10 years, 22% less than 10 years, while only 1% had been
less than a year employed.
89% of the perpetrators were internal people, while only 20% of them
were externally associated with the company.
The survey highlights the count of crimes since last year has risen
from 39% to 60%. It states lack of effective monitoring and fraud risk
management programs as the driving factors for the rise in white
collar crimes.

Uddhav Thackeray only”, said Jaya Bachchan, who is the wife of Amitabh
Bachchan and Rajya Sabha MP from Samajwadi Party. She said it in a
press conference in Mumbai in the reaction of Raj Thackeray’s comment
against Big B that he didn’t do anything for Mumbai when Mumbai has
given him such name, fame, and money.
The major question is – Who is Raj Thackeray? Is he like Kalyan Singh
without Bhartiya Janta Party, Raj Babbar without Samajwadi Party, Uma
Bharti without BJP, Natwar Singh without Congress? I think yes, Raj
Thackeray is now Raj Thackeray without Shiv Sena. And he is
desperately trying to be in media all the time like his ‘Sena’ days.
He has become infamous for doing ’shortcuts’ to get cheap popularity
and this time he has opted the God Sun (Chath Puja), Amitabh Bachchan
and his favorite ‘Biharis’ to polish his politics.
Let me tell you who Raj Thackeray is in detail. Raj Thackeray is a
young Indian politician of Maharashtra and best known as nephew of
Bala saheb Thackeray till date. He started his political career with
Shiv Sena in Maharashtra and it was possible because he has the title
‘Thackeray’. He started dreaming to become the chief minister of
Maharashatra in the initial phase of his political career. He even had
revealed his wish in 2004 but didn’t contest the assembly elections.
He had the status of number three in party but had a dream to become
number one by overtaking Uddhav Thackeray, son of Bala Saheb. Later,
he was sidelined and forced to give way to Uddhav to become Shiv
Sena’s executive President in 2005. Raj, highly ambitious youth,
decided to leave Shiv Sena and float a new party, Maharashtra
Navnirman Sena (MNS) to fulfill his dream. He believes he has wide
support in Maharashtra, particularly in Mumbai. However, he failed
completely in establishing himself in the last assembly election and
the civic body polls in the state. On the other hand, Uddhav managed
everything correctly in Shiv Sena, the party without Narayan Rane,
Chagan Bhujbal and now Raj Thackeray.
Raj has another quality in him; he admires Nazi dictator Hitler for
his organizational skills and strong will power. On his 37th birthday
in 2005, he said:
“‘Leave aside his negative aspects like the barbaric annihilation of
millions of Jews. There are several other things about Hitler, which
any leader would envy. Hitler had everything. The one thing he did not
have was the ambition to conquer the world. You can draw whatever
conclusions you want from my remarks.’
”People are talking about Raj as a desperate youth leader who is ready
to do everything to get a status of full fledged political leader in
the state. He wants to remain in media discussion so he opts to
criticize Chath Puja (famous festival of Bihar and UP) and Amitabh
Bachchan. He knows it better that by targeting ‘Big’ things; he would
automatically arrive in media limelight.
He sends goon to carry attack in media offices, to beat people of
Bihar and Uttar Pradesh on streets, to disrupt press conference of
other political parties, to hurl bottles in superstar’s houses, to
beat the jobless examinees, he says Juhu molestation case happened on
the New Year Day because people of Bihar and UP are living in Mumbai,
He says no Maharashtrians can do such acts, he threatens Biharis to
slap on their cheek every time, he admires Hitler and believes in
behaving like Nazi dictator, he can’t win even civic polls but aiming
to become the chief minister of Maharashtra or get the status of Bala
Saheb in the state, he wants to become Hindu leader but abuses Chath
Puja, the festival of Sun; he wants to reconstruct (Navnirman)
Maharashtra but believes highly in regionalism at threatening extent.
He aims to become a mass leader and becoming the leader of ‘goons’.
Migrants laborers are being target of separatists and militants in
Border States in northeastern states, and in Maharashtra now,
Thackeray is targeting them. Does Maharashtra really need this

harmony among people living in Mumbai. He deserves tight slaps on both
of his cheeks for his anti-nation activities. It was strange to see
him attending Mumbai’s top cop’s daughter wedding even a non-bailable
warrant was issued against him by Mumbai Police. Isn’t this a joke of

Friend, I have been living in Chakan near Pune from quite sometime
working in Volkswagen. (We call it Folkswagen though)
I was very much interested in the issue regarding all this, and why
that BMW went to Tamil Nadu despite the good infrastructure and
excellent support extended by state Govt. as well as from people here.
Most of my colleagues are Marathi and I got a reply to the above chain
mail in my inbox from him. This one single email is enough to
understand the issue I suppose.
I am not an Indian national by the way, I am from Britain. So, please

first. This way, we ensure no one is educated. Basically, why should

the East. Why should we worry about the constitution of India? It was
written by a Marathi Manoos by the name of Ambedkar. After all,

Chhath Puja is supposed to be performed in river Ganga. It should be

Visits to Mumbai, Pune, Nagpur, Nashik, Aurangabad, Ajanta and Ellora

there! My colleagues are busy getting a hands on knowledge of the

When people talk about Marathi vs non marathi issue that is seamering
these days, they seem to miss the main point. It is OK for people to
migrate within a country but it becomes an issue when this migration
is happening on large scale. When such a large number of people
migrate from north to Maharashtra it creates problems for the local
people and their culture. And this issue must be addressed. Violance
that SS or MNS are doing in Mumbai is absolutely wrong but that does
not mean their point is not valid. They do have a very valid point.
The same thing could happen in any other state.
One other point worth noting is that in Maharashtra land reforms were
successful to large extent but in UP/Bihar they were not. That has
created major social inequality in those states. Maharashtra is not
only economically well developed but it is also socially advanced
state. This is mainly due to social reformers like Agharkar, Phule,
Karve, Ambedkar etc. Credit for all this certainly goes to
Maharashtrians.

Asma Jehangir Fears India Under Threat Of Another Communal Riot

On her 18 day visit to India as UN Special Rapporteur on Freedom of
Religion and Belief, Asma Jehangir, renowned lawyer and human rights
activist of Pakistan, found that India, although a secular country
with sound religious legal framework, lags behind in meting-out
justice to its religious minorities.
Jehangir, who visited Amritsar, Delhi, Jammu, Srinagar, Ahmedabad,
Mumbai, Thiruvananthapuram, Bhubaneswar and Lucknow, for her study,
hailed India for its democratic values and human rights activism.
She found that although the minorities agreed that there is a sound
legal framework to protect religious freedom, yet they are
dissatisfied with its implementations. There are undue delays in the
investigations where communal riots are concerned. It is spreading
disillusionment and dissent among the religious minorities.
In the past two decades there have been major incidents of religious
violence; like the demolition of Babri Masjid, violence against
Muslims in Gujarat in 2002, atrocities against Christians in Orissa
last year, that have escalated out of proportion because of unheeded
impunity given to the perpetrators and political parties using
religion as a political tool to gain voter bank.
Jehangir warns if the situation is not checked soon, there might be
another major communal violence looming in the near future. She hopes
that active participation from the government and non-state actors can
help to dispel dissatisfaction among the minorities and bring about a
more conducive environment for all.

Minorities are always under threat to be killed by Hindu nationalists
in communal riots at any point of time. the state government sometimes
support the Hindu groups to kill minorities. Muslims are living life

Jehangir may be correct, well for that matter the political parties
have been playing the vote bank card. This problem is even with the
Hindu majority in our country, which have been divided into various
categories e.g. the OBCs, SCs and the STs.
So the main problem does not only concern the minorities, infact the
reality is that the reserved classes representing the Hindu Majority
have a representation right up to the parliament which is not the case
with the minorities.
We must have a certain percentage of minorities’ representation in the
parliament and mandatory provision for reserving seats for them just
like seats are reserved for reserved classes whilst contesting
elections.
As far as the investigations of communal riots are concerned, this
problem is also confronted by other criminal matters i.e. the quantum
of delay is even eminent there. The only remedy in the matters where
the communal riots are involved is that they must be taken up by fast
track courts. If these riots happen to occur at grass root levels then
the mobile courts could be a remedy.

Woho!!! Arsalan when did you visit Gujarat or Maharashtra...probably
something you saw over a PTV broadcast...and if you know about the
aforesaid states u must have heard off Jamia in New Delhi.
Once our Cab Driver unintentionally hit a Muslim vegetable grocer in
that area and atleast a 100 Muslims were ready to chop us all at one
go. It was not before the cab driver parted away with 3 grands and
rubbed his nose on the grocer’s feet, that we were allowed to go.
Just for your records: I am not a religious stickler and have never
believed that a Muslim or a Hindu breathe differently. It’s just the
colour given to these issues by political parties and nothing more. No
religion preaches to kill. Sensationalist Media propagation is what
made you think all that. We love Muslims just the way we love Hindu’s.
Don’t just write what you feel/think but mention what you personally
experience.

The Rise Of White Collar Crimes In India

A recent survey reveals the dark side of the corporate India, the
growing number of white collar crimes committed every year. KPMG
India, an audit and consulting firm associated with its Swiss
Cooperative, KPMG International, has published its recent Fraudster
Survey 2007. The findings were collected from a questionnaire survey
sent out on October 2007 to India’s largest organization in public and
private sectors. The respondents included senior management
officials.
Greed, opportunity and pressures to meet budgets and targets are the
most overriding motivations for white-collar crimes. Surprisingly,
most of the crimes were committed by senior level officials; 86% of
the fraudsters held management positions of which 60% were either at
senior management level or in the board of directors. Of these 68% of
the profilers were acting independently and they were not satisfied
with one time act, but 91% of the fraudsters had repeatedly cheated
their company.
The number of years with the company didn’t have a positive effect
either; about 26% of the employees had been 3-5 years in the company,
29% of them 6-10 years, 22% less than 10 years, while only 1% had been
less than a year employed.
89% of the perpetrators were internal people, while only 20% of them
were externally associated with the company.
The survey highlights the count of crimes since last year has risen
from 39% to 60%. It states lack of effective monitoring and fraud risk
management programs as the driving factors for the rise in white
collar crimes.
